Appeal Court Affirms Judgment Barring VIO From Stopping, Impounding Vehicles

Activist Abubakar Marshal took the matter to court after VIO officials stopped him at the Jabi District in Abuja on December 12, 2023 and confiscated his vehicle.

The Court of Appeal in Abuja has affirmed a judgment of a Federal High Court Abuja, which barred the Directorate of Road Traffic Services, also called VIO, from further stopping, impounding, or confiscating vehicles on the road and imposing fines on motorists.

In a unanimous judgment, a three-member panel of the appellate court resolved the three issues identified for determination against the appellant, the Directorate of Road Traffic Services.

Delivering the lead judgment, Justice Oyejoju Oyewumi, held that the appeal was without merit.

Justice Oyewumi further awarded a cost of N1m against the appellant and in favour of the respondent, a rights activist and public interest attorney, Abubakar Marshal.

Justice Nkeonye Maha of the Federal high court had declared that no law empowered the VIO to stop, impound, confiscate, seize or impose fine on motorists for any form of violation.

The judgment followed a fundamental right enforcement suit which was filed by Marshal.

The applicant told the court that he was forcefully stopped by VIO officials at Jabi District in Abuja on December 12, 2023, and his vehicle was confiscated without any lawful justification.

Among others, he prayed the court to determine if the action of the VIO officials was not wrongful, oppressive, unlawful and a gross violation of his fundamental human rights.

While granting the reliefs that were sought by the applicant, Justice Maha specifically restrained the respondents, either through their agents, from impounding and confiscating vehicles or imposing fine on any motorists, as doing so would be wrongful, oppressive and unlawful.

Just In: SMART SCHOOL OR SMART LOOTING? ANOTHER RECEIPT FROM IGBERE

This image is Elu-Okwe Primary School in Amaukwu Igbere, Bende LGA—a living, breathing school, not a rumour or propaganda. Yet the Abia State Government claimed it was demolished because it had been awarded for upgrade to a smart school. Today, no smart school exists. The roof is failing, classrooms leak, and pupils still run for cover whenever it rains. Despite community appeals for urgent renovation, intervention was halted on the grounds that the project had been “awarded.” Months later, nothing has happened. This raises serious questions about the state’s claim of spending ₦100 billion on public school repairs. Smart schools do not disappear, and infrastructure does not exist only on paper. Abia people are no longer asking for explanations—they are demanding results. Where are the smart schools?

Just In: Press Release From the Office of the Deputy Speaker, House of Representatives

The Office of the Deputy Speaker of the House of Representatives has dismissed as false and misleading the Abia State Government’s claims concerning infrastructure projects attracted by Rt. Hon. Benjamin Okezie Kalu. The office clarified that the land along the Umuahia–Bende Road was communally donated, not allocated by the state government, and described allegations of unauthorized demolition of school facilities as baseless. It further accused the Otti administration of deliberate propaganda aimed at undermining genuine development efforts, while reaffirming the Deputy Speaker’s commitment to attracting critical infrastructure to Abia State in the interest of the people.
